Terms of Service

Welcome to Pocket Linguist. These Terms of Service ("Terms") govern your use of the Pocket Linguist mobile application (the "App") operated by Pocket Linguist ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you:

• Are at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Will use the App only for lawful purposes
• Will comply with all applicable laws and regulations

2. Description of Service

Pocket Linguist is a language learning application that provides:

• AI-powered translation and language practice
• Vision-based vocabulary learning using your device camera
• Interactive roleplay conversation scenarios
• Pronunciation practice with speech recognition
• Vocabulary review with spaced repetition
• Progress tracking and achievements

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

3. Subscription and Payment

3.1 Free and Premium Tiers

The App offers both free and premium subscription tiers. Free users have access to limited features, while premium subscribers ("Pocket Linguist Pro") receive full access to all features.

3.2 Free Trial

New users may be eligible for a 7-day free trial of Pocket Linguist Pro. The trial provides full access to all premium features. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

3.3 Subscription Terms

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Your subscription will automatically renew at the end of each billing period
• You may cancel your subscription at any time through your app store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds will be provided for partial subscription periods

3.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice of the change.

4. User Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems or software to extract data from the App
• Transmit any viruses, malware, or harmful code
• Violate any applicable laws or regulations
• Use the App to harass, abuse, or harm others

5. Intellectual Property

5.1 Our Rights

The App and its original content, features, and functionality are owned by Pocket Linguist and are protected by international copyright, trademark, patent, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial language learning purposes in accordance with these Terms.

5.3 Third-Party Content

The App may utilize third-party services including Google Gemini API for AI features. Use of such features is subject to the respective third parties' terms of service and privacy policies.

6. AI-Generated Content

The App uses artificial intelligence to generate educational content, translations, and conversational responses. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• Translations are provided for educational purposes and may not be suitable for professional or legal use
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• You should verify important information through other sources

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our privacy practices as described in the Privacy Policy.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
• ACCURACY OR RELIABILITY OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POCKET LINGUIST, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your use or inability to use the App
• Any damages exceeding the amount you paid for the App in the twelve (12) months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless Pocket Linguist and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if:

• You breach any provision of these Terms
• We are required to do so by law
• We discontinue the App

Upon termination, your right to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top of these Terms and, where appropriate, through the App. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pocket Linguist regarding your use of the App and supersede all prior agreements and understandings.
